These Terms of Service ("Terms") govern your use of the WhatsBizAPI platform ("Service") operated by WhatsBizAPI ("we", "us", or "our") at https://whatsbizapi.com.

1. Description of Service

WhatsBizAPI provides a WhatsApp Business API platform that enables businesses to:

  • Connect their WhatsApp Business accounts via coexistence setup
  • Send and receive messages through the WhatsApp Business API
  • Create and manage message templates
  • Run marketing campaigns
  • Manage contacts and conversations
  • Access analytics and reports

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our Service.

2.2 Account Information

You agree to provide accurate, current, and complete information during registration and keep your account information updated.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Subscription and Payment

3.1 Subscription Plans

We offer various subscription plans including free trials and paid plans. Details of each plan are available on our pricing page.

3.2 Payment

  • All paid subscriptions are processed through Razorpay
  • Prices are displayed in INR and USD
  • Payments are charged at the beginning of each billing cycle

3.3 Free Trial

Free trial accounts have limited features and usage quotas as specified on our pricing page.

3.4 Refund Policy

Please refer to our Refund Policy for details on refunds and cancellations.

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam or unsolicited messages
  • Violate WhatsApp's Business Policy or Terms of Service
  • Send illegal, harmful, or offensive content
  • Impersonate others or misrepresent your identity
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Harvest or collect user data without consent

5. WhatsApp Compliance

5.1 WhatsApp Policies

You must comply with WhatsApp's Business Messaging Policy, Commerce Policy, and all other applicable WhatsApp policies.

5.2 Message Templates

All message templates must be approved by WhatsApp/Meta before use.

5.3 Opt-in Requirements

You must obtain proper consent from recipients before sending them messages.

6. Intellectual Property

6.1 Our Property

The Service, including its original content, features, and functionality, is owned by WhatsBizAPI and is protected by intellectual property laws.

6.2 Your Content

You retain ownership of content you upload to the Service. By uploading content, you grant us a license to use it for providing the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

8. Indemnification

You agree to indemnify and hold WhatsBizAPI harmless from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or messages sent through the Service

9. Service Modifications

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change pricing with reasonable notice
  • Update these Terms as needed

10. Termination

10.1 By You

You may cancel your subscription at any time through your account settings.

10.2 By Us

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable period.

11. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be resolved in the courts of Thane, Maharashtra.
